USCIS Returning H-1B Cap Petitions

The United States Citizenship and Immigration Services (USCIS) announced on May 4, 2015 that is has completed data entry of all fiscal year H-1B cap-subject petitions selected in their “computer-generated random process.” Therefore, they have started the process of returning all H-1B cap-subject petitions that were not selected.

If you have not received a receipt notice for your H-1B visa CAP petition, it is safe to say that the petition was not selected and will be returned. The time frame for returning these petitions is uncertain because of high volume of petitions they will be returning. The USCIS will make an announcement once all the petitions have been returned.

This is the time to reevaluate your immigration situation and consult with an immigration lawyer regarding your options.
