Employers Should Prepare Now for the H-1B Cap Registration Period

H-1B Cap Registration:  Employers can register for H-1B visas from March 9 through March 25, 2021, for the fiscal year (FY) 2022 (October 1, 2021 to September 30, 2022).

  • During this timeframe, H-1B cap-subject employers, including those eligible for the advanced degree exemption, seeking to file a FY 2022 H-1B cap petition will be required to first register electronically with USCIS and pay the associated $10 H-1B registration fee for each submission.
  • Prospective petitioners or their authorized representatives must electronically submit a separate registration naming each worker for whom they seek to file an H-1B cap-subject petition. Duplicate registrations are prohibited.
  • After the initial registration period closes, the USCIS will notify registrants with selected registrations no later than March 31, 2020.

H-1B employers and employees should contact their attorneys now to prepare for the registration period.
